Question about the warranty

I'm looking to purchase a (slightly) used Phoenix Pro 120GB from ebay. The seller said it is only a few weeks old, and will include a copy of the original purchase invoice from newegg. My question is, does the warranty transfer? If something goes wrong, will I be able to use his invoice for an RMA? Thanks.

Memory or SSD within the warranty period has a full warranty.
Unless the hardware has obvious malicious damage.
