Cold Boot issue with F3-12800CL9D-4GBNQ and Asus m4a89gtd

it seems I have the Asus cold boot issue.

I have F3-12800CL9D-4GBNQ 2x2 kit
Phenom 955 rev C3
ASUS M4A89GTD PRO/USB3, Flashed to latest Bios (1005)

I have tried setting the timings manually (and auto), raising the voltage to 1.55, using only 1 stick, Setting the speed to 1333, etc.

Does this qualify for an RMA? If so, generally how long will it take? I don't have any other ddr3 on hand. Now that I know why the system is crashing, I can hold out for a while if ASUS has plans to fix this with a bios patch.

Go ahead and send them in for new replacements. RMA's generally take a week, so it is not long at all.
